FOX23 was at Alta Vista Pet Lodge in Tulsa as the Delaware County Sheriff’s Office loaded up 15 dogs to take back to Jay, Oklahoma.

According to District Attorney Kenny Wright, deputies believed Chris and Claire White opted to surrender the animals back in July when they were arrested for animal cruelty.

Documentation filed on behalf of the suspects’ says they thought the dogs were taken for evidence purposes only. They said they did not surrender them.

A judge sided with them Thursday and said the surrender document was unclear.

Ten felony animal cruelty charges are still pending against the Whites. Their next hearing is set for Jan. 27.
