49ers take Smith off NFI

Santa Clara, CA (SportsNetwork.com) - The San Francisco 49ers activated linebacker Aldon Smith from the non-football injury list on Thursday.

Smith had been on an indefinite leave of absence from the 49ers to seek help for a substance-abuse problem. He left the team just days after a Sept. 20 arrest on suspicion of driving under the influence and possession of marijuana.

The 24-year-old also reportedly turned himself in to authorities on Tuesday night after being charged with three felony counts of possession of assault weapons earlier in October. Smith posted a bail of $75,000, according to multiple reports.

Smith faces a court date for the weapons charges on Nov. 12, just one week before he's scheduled to be in court to face misdemeanor DUI and drug charges resulting from his previous arrest.

The weapons charges against Smith stem from a 2012 party the All-Pro linebacker hosted where he was stabbed and two others were shot. The cops found assault rifles, magazines and ammunition at the party.

On the field, Smith has been one of the NFL's premier pass rushers since being taken by San Francisco with the seventh overall pick of the 2011 draft. He notched 14 sacks during his rookie season, then ranked second in the league with 19 1/2 sacks last year while helping the 49ers to an appearance in Super Bowl XLVII.

The 49ers are currently on their bye week and return to action against Carolina on Nov. 10.
