Cleveland police arrested 37-year-old Lynn Marie Smith Friday night right before she said she was about to turn herself for being accused of providing alcohol for minors and for stealing from a liquor store.
Police tell FOX23 News five people were at a drunken sexual party that included teenagers at 12-years-old, 13, 15, 16 and 18-year-old Daniel Allen Arbuckle on June 5th. Police Sgt. Robert Stephens said after interviewing the 12 and 13-year-old girls he learned Arbuckle had sexual intercourse with them and had oral sex with the other girls there.
Arbuckle was arrested last month on rape charges and made his first court appearance. He sits in the Pawnee County Jail.
Smith arrest warrant was issued on July 16th. FOX23 talked with her after her mother bonded her out of jail Friday night around 7:30.
“It’s not fair; it’s not fair at all because I know in my heart, I didn’t buy alcohol for minors,” said Smith.
Smith admits she stole a bottle of liquor from the local liquor store in Cleveland and put all the bought and stolen alcohol into the refrigerator when she arrived back at her boyfriend’s house, where the party happened.
“He was drunk, when I walked in,” said Smith. She said she could hear music blaring when she pulled up. “He was taking shots, and there are no charges against him at all. I told him that none of the people needed to be there, and he told me it was his house and I could leave.”
She left the house, she said. Her mother, Rhae Smith confirmed her daughter stayed with her that night.
They did not find out until days later what happened over at Smith’s boyfriend’s house. Rhae Smith said she talked to the 12 and 13-year-old girls who told her they consented to having sex with Arbuckle.
“The exact right words that came out of their mouths were, he was having sex with one, and the girls were licking caramel sauce off each other and everybody just switched off except one little girl refused to have sex with another girl,” said Rhae Smith.
Lynn Smith does not understand why she was never questioned by police to hear her side of the story nor does she understand why her boyfriend, the owner of the “party house” has not been questioned either.
Arbuckle is being held on a $100,000 bond.
