The district attorney's office tells FOX23 Stacy Digney will serve five days with the possibility of more jail time depending on how her court hearing goes Dec. 2.
Stacy Digney is a Bartlesville mother who has been sentenced to jail time for not sending her three kids to school.
FOX23 wanted an answer on why she allegedly didn't just send her kids to school after she received her first notice, so we tried tracking her down at this house, but no one was there.
We did end up talking to one her neighbors, and they tell us they've seen the kids multiple times.
"I had seen them out in the yard wondering why they weren't in school."
We asked him, "Where is she?"
Neighbor replies, "I think she moved a couple of weeks ago. It was very sudden."
We decided to speak with the district attorney's office about the case.
FOX23 spoke with Aaron Pembleton, Washington County assistant DA.
We asked Pembleton,
"Ms. Digney gave you a reason she's not sending her kids to school. What is it?"
"She's had a hard time getting up herself so she can't get her kids up to go to school.. and that's one of the reasons she didn't send them."
Someone who lived with Digney told a neighbor we spoke with another reason.
He said that the oldest one didn't want to go.
According to the affidavit, this was an ongoing problem, starting in February of this year.
The affidavit also states Digney's three kids missed a combined "91" complete days of school over a four-month period.
Neighbors aren't sure where she's at.
Every neighbor we spoke with tells us she just moved out and no one has heard from her since.
The district attorney's office tells me her first of 5 five days in jail starts Friday.
Digney was convicted on 10 counts of "failure to compel child to attend school" but it was only based on one kid.
FOX23 will dig into the story more to find out what will happen when her other two kids' trial begins.
