The Tulsa County District Attorney’s Office will not seek the death penalty against a man charged in the murder of an 84-year old Tulsa woman.

At an arraignment on Monday, Assistant District Attorney Steve Kunzweiler announced the DA will not pursue a death sentence for Tyrone Dale David Woodfork.

Woodfork is charged with first-degree murder in the March 2012 death of 84-year-old Nancy Strait. Woodfork, 21, faces a First-Degree Murder charge and two First-Degree Rape counts in connection with the March 2012 death and sexual assault of Nancy Strait. He also is charged with two counts of armed robbery and single counts of first-degree burglary and assault and battery with a dangerous weapon.

Kunzweiler said a major factor in that decision was Woodfork's mental limitations.

"There was much debate within our office as to whether we should seek the death penalty on this Defendant because of the egregious nature of the crime and the age of Ms. Strait. But ultimately the fact he had a borderline IQ score, as well as other mental history, led us to our decision," said First Assistant District Attorney Doug Drummond

"We discussed this with the family members during the course of the decision and explained the pros and cons. The bottom line is that our office believes justice will be served in this case if the Defendant is sentenced to prison for the remainder of his life with no chance of getting out. We hope that the upcoming jury trial gives some closure to the family for this tragedy, and, at the same time, properly holds the Defendant accountable for his actions,” said Drummond.

District Judge William Kellough scheduled an Oct. 21 jury trial for Woodfork.

You mean to tell me that you won't seek the death penalty becausehis IQ is low. I could have told you he was stupid. Above and beyond all that Woodfork was just plain unkind. Targeting weak elderly people and then raping that poor woman to death. I hope he gets some of the same ...
