A suspected illegal immigrant accused of hitting and killing 74-year-old Beverly Duffield on her bike this week has prior arrests.

City of Tulsa records show 28-year-old Roberto Alvelais-Torres has been arrested at least twice before this week’s arrest.

FOX23 broke this story first at 6:00pm on FOX23.com.

FOX23’s Abbie Alford has been digging into this story and found this isn’t Torres’ first hit-and-run charge.

Municipal court records show in 2003, Tulsa Police arrested Torres for DUI/Alcohol, Hit & Run, Transporting Beer and No Driver’s License.

Records show a day later he bonded out of jail and after about eight months Torres stopped showing up for court.

Tulsa Police then issued a warrant for his arrest.

Immigration Customs Enforcement (ICE) will not confirm if he was deported at that time.

However, that wasn’t Torres’ last run in with Tulsa Police. Records show three years later officers arrested him again on that 2003 warrant. Records show The City of Tulsa Court found him guilty and no jail time but Torres paid a $745 fine.

So what happened between 2003 and today?

FOX23 is being told ICE did make contact with Torres both times. Officials say that would mean Torres-if he were deported or voluntarily left the U.S and returned to the country-he would be considered an aggravated felon.

Gosh esposadenacho, I have actually agreed with a couple of your last posts. I'm really not as mean spirited as you might have thought, just have very strong convictions. My basic belief is that we should all play by the same rules, and no exceptions or excuses.

Death penalty is what he deserves. Nothing less.

True but the problem with that is...well, everyone expects too much and has high regards for our justice system which sucks. Considering the Tulsa jail has let inmates walk right out the door and allowed a child molester to go back living next door to the young victim who put him in jail in the first place, well, I am not surprised the Tulsa courts would allow this either. Tulsa needs replacements in the criminal courts. Unless that happens we will continue to have "mishaps" that put citizens in danger.

Possibly, but not likely nacho. "Legal" probably don't have too much importance to someone with 3 past arrests and a criminal history. Regardless, he should spend the rest of his life behind bars, not slapped on the hand.

Notice the word "SUSPECTED". Half of you don't spell correctly and none of you read the whole article, including the title. If he has been arrested and released before then is it possible a guy with a hispanic name could possibly be, GASP!, legal?

Until people wake up and have the nerve to demand that the EMPLOYER be held responsible for these illegals nothing will ever change. That will probably never happen because it is too profitable for them and the big bucks they can make from the cheaper labor. Let the average hard working Joe pay for their subsidized housing, free school lunches for their kids, free health care, Food stamps, no driver's license, no insurance, and most likely no tax's. Let's require everyone to be bi-lingual in order to obtain a job, and require all existing establishments, police, fire, schools, etc. to have bi-lingual personnel on their staffs. This is the United States of America, not the United States of Mexico. Well, not yet anyway. If the employer wants to reap the higher profits they obtain at someone else's expense, then they should be MADE to help contribute to subsidizing all the social programs these illegals receive. The solution seems simple, no jobs for illegals, no illegals. Please, don't tell me they only take the jobs nobody else wants. That dog won't hunt! There is estimated to be around 20 million unemployed, the estimated number of illegals is around 14 million, ( who knows the real number). It's all about dollars. Is it illegal to speed, is is illegal to run a stop light, or violate any other law? If we ENFORCE these laws and punish those who violate them, then why do we not punish those who violate our laws and enter our country illegally? Let's get serious about this problem and start punishing those who offend. Perhaps, if this had occured in the past, this unfortunate accident could have been prevented, and this lady would be alive today. We can invade 2 countries, and we have yet to secure our own borders. It's disgusting!

i think first the problem is the people the ones to drive on trafique roads whit bicicles is not apropiade, roads are for motorised car.not for pedestrand whit bicicles.if you al people ones to drive bicicles is why, is parks or special places to mantening you healthy sports.(lets compare to speed car30milles/hr and to bicicles on the same speed,is not way the weight is goin to be the same on make to stop on the same time ). i am not agree whit what this man do to the lady, but if is for imigrants, send all them to theres countrys,no only latinos or people the looks like them, i say all the imigrants.and for the people the one to send all the imigrans to there countrys.you people need to leard to do the jobs the this people do and get you lasy butt and stared doing something for you onw country. i like to this man get what hi deserves for the accident the hi make.if the people say hi is to criminal, you people need to stared leard what criminology is?if is at mistake or accident.we are all make mistakes and we are going to pay for.but what you people need is to leard how to get together to make you comuinity more safe.people is compleing not yes for the color but becouse they don t work for what they one.

Slim Jim, I know a Mexican guy that is an illegal and WAS Deported. He beat the bus back to Tulsa that took him to Mexico. I'd report him but his wife makes the best Salsa and Enchiladas! Truth is, we need better security at our borders.

Kudos to our "system of justice" Why was this loser allowed to even enter our country in the first place? why was able to continue breaking the law without any substantial consequences? How long will the "left" allow these animals to destroy our nation?wow makes me want to hop on my bike and ride somewhere-How many times until we really punish these filthy garbage bags?

muleman - 9/3/2009 7:05 PM
Since Tulsa is a "safe city" we welcome this kind of scum with open arms, all in the name of "diversity". Think before you vote in the upcoming election. Liberal ideology is turning our city and the rest of the nation into a cesspool.
