A woman who has been behind bars for a year for driving drunk and slamming into a family and taking two lives wants out of prison.
However, a judge said no to Nancy Rueb, 44, for the November 2008 accident on U.S. Highway 75 near the 71st exit.
FOX23’s Abbie Alford was in the courtroom when the victim’s family says they saw a woman who has no remorse.
Two children at the age of six and seven lost both of their mothers. Their biological mother died of diabetic complications and then a year later their grandmother, 59-year-old Viola Tolbert was hit and killed by Rueb.
Their uncle, Cody Spears, 27, was also killed. He was fixing a tire on U.S. 75 when Rueb slammed into their 1994 Buick Century.
Emily and Buddy Snow were inside and so was Cody’s wife Shelly, they live but now have scars.
"Anyone that gets caught drinking and driving and kills someone should spend life in prison without a chance of serving parole it's the same thing as taking a gun and killing someone," says Cody’s Stepfather Eldon Small.
Instead, Rueb will serve at least 17 years of her 25 year prison sentence. Today a judge gave her a 20 year sentence with five years parole.
"20 years is a long time to spend in prison. It's better than only doing two," says Cody’s mother Karin Small.
Rueb’s attorney pleaded to get her out of prison sooner saying she was sorry and was getting alcohol abuse treatment.
Cody’s parents say there’s no excuse.
“To me if you have the nerve to file a modification then I don’t think you are sorry she was thinking about herself not what we lost. We got a life sentence," says Karin Small.
Rueb’s defense attorney says it’s about moving on.
"that's easiest enough for them to say. We are Christians we are taught forgiveness. These people want revenge they don't want forgiveness and I can't help that," says Paul Brunton.
Prosecutors say this wasn’t Rueb’s first alcohol-related offense. She had previously been pulled over for a DUI but charges were dropped to Reckless Driving.
Prosecutors say she was involved in another alcohol-related crime and a month before the fatal accident she wrecked her car. The Fire Department told the DA they smelled alcohol on Rueb but no charges were filed.
"This isn't right. This needs to be stopped," says Eldon Small.
Rueb will have to serve 17 years of her 20 year prison sentence pluse 5-*year suspended sentence.
Rueb is being held in a woman's prison in McLoud.
