Registered sex offenders lives by school and park

The registered sex offender arrested for trying to sexually assault a 14-year-old girl wasn't breaking the law by living close to a school and park.

"You hear something like that and it's terrifying, that could been my kid," said Shannon Ryan.

The mother lives near registered sex offender Peter Nolan. The 27-year-old was arrested by Broken Arrow Police shortly after the teen escaped and ran to her school to call for help. The attack happened not far from where he lives, in the 3300 block of S. Fir in Broken Arrow.

Officers say registered sex offenders such as Nolan are known to be "grandfathered in", meaning they can return to the same home they lived in before conviction.

In 2007, he pleaded guilty to sexually battery after prosecutors say he assaulted a woman walking into the restroom where he worked near 101st and Elm. He was sentenced to five years.

Documents show Nolan was released from probation in September, 2012 for the sexual battery charge.

Eight months later, he was accused of lewd molestation and lewd proposals to a 14-year-old.

Mrs. Ryan's daughter also walks the same route to school.

"That could have been me or someone else walking to school," said Ryan's daughter.

FOX23 News has been investigating registered sex offenders living in safe zones since November, 2012. Smartphone Apps will show a sex offender living within 2,000 feet of a school, park or daycare and it's not illegal.

Lawmakers grandfather registered sex offenders by allowing them to move back to their residence they lived when they were convicted even if it is in the 2,000 foot rule.

"I don't like that, I don't like that all," said Ryan.

Nolan used the same address he lives now as he did when he was charged in 2007.

"Someone living that close to our family and families in this neighborhood there has to be something done, something done to protect our children," said Ryan.

However, police say if the register sex offenders temporarily lives in another residence or hotel upon release from prison they give up the "grandfather" right to live in safe zones.

"We live in a neighborhood we think is safe and it always has been safe that something this close could happen," said Ryan.

She had no idea Nolan was a registered sex offender. Nolan told police he had been living in that home near the school since he was age five.

Online Sex Offender Registry records show Nolan is a lifetime sex offender and a level three. He must register with police every three months. Officers say he has been compliant since he was released from Department of Corrections.

Broken Arrow police are holding Nolan on $75,000 bond. Since he is felon the scheduled bond would be set at $125,000. Once he is booked into the Tulsa County Jail his bond could be increased and a judge could also increase his bond.

Im not seeing where he was identified as a suspect, just that he is registered to live in the neighborhood. Updates?
