Rape conviction overturned for man accused of raping sleeping woman

A California appeals court has overturned the rape conviction of a man who pretended to be a sleeping woman's boyfriend, saying in part that an arcane law from 1872 doesn't protect unmarried women in such cases.

It was non consensual, same if he had worn a mask or put a blindfold on her and raped her. California is a sick place...will be glad when it finally does fall off into the ocean.

The sex was obviously not consensual, so what else would they call it? I call it rape. Believe me, if it had been in Oklahoma that guy would have gotten more than a 3 year sentence and the conviction would have been upheld. California lawmakers are a bunch of idiots!
