OK Sex Offender Tier System

Your son or daughter could be having sex and consenting to it with another teen.

Fox 23’s Abbie Alford discovered about Oklahoma law may surprise parents who may end up with a teenager branded for life as a registered sex offender.

Ricky is a 19-year-old boy; he’s asked that Fox 23 not disclose his last name in fear of vigilante’s. Under the Oklahoma State Department of Corrections Sex and Violent Crime Offender Registry, Ricky is charged with Lewd Or Indecent Proposals/Act To A Child.

At age 16, In Iowa, Ricky says he had sex with a girl who told him she was 16-years-old.

It wasn’t until an officer showed up at his door telling him the girl was really 13-years-old.

In a plea agreement Ricky was sentenced to two years probation and ten years on the sex offender registry.

Since then an Iowa judge expunged Ricky’s case but three years later he’s moved to Oklahoma and says it’s been nothing but a nightmare.

Now he wants to warn other teens it could happen to them.

"I don't have anything but my mom or my little brother or my family and nothing else," says Ricky.

However, Ricky says he does have hope. Hope he can he just be a teenager again.

Instead this 19-year-old boy is branded a child rapist for having sex with a teenage girlfriend who told him she was 16-years-old. 

"It's a nightmare to wake up everyday just hoping that something will change," says Ricky.

Ricky's mother, Mary Duval is legally blind so Ricky has to take care of his family but he can’t find a job.

"I think I fed my baby to the wolves," says Duval.

Ricky is like many teens who face the same pressure of teenage sex.

This law is moronic. He was a CHILD when this occurred. There was no violent act, no coercion. If anything, the GIRL should be charged for being in the club illegaly. The club should be sued by Ricky's parents for allowing someone who was 13 into the club for 16-20 year olds. Another point: WHY is there a club for 16-20 year olds? That just SCREAMS "hook up with young teen girls". This is the same thing as an adult going to a real BAR, and hooking up with a girl, only to find out she lied to them about her age, has a fake ID (that she used to get into the bar as well). What? Are we supposed to be held responsible for someone who LIES about their age? How the hell are we supposed ot know 1000% that someone isn't lying? Have you seen how parents let their 13-17 year old daughters out of the house lately? My Daughter is 13. I do not let her out of the house in short skirts, caked on whore makeup, or anything that reveals. This girl's parents should be ashamed of themselves. Not only did they FAIL at raising their child. They also FAIL at judgemental reasoning. THEY are the ones to blame for letting their daughter even get NEAR that club. I also have two sons who will be teenagers in the next few years. Is this the type of CRAP that I'm going to have to wring my hands about? Guess I'll be putting padlocks on all my doors and windows....... What a crock.... EACH CASE WHERE SOMEONE IS TO BE PUT ON A SEX OFFENDER LIST SHOULD BE INDIVIDUALLY REVIEWED. PEOPLE PURPETRATING THEIR AGE SHOULD BE FINED. PARENTS OF CHILDREN WHO ARE CAUGHT IN PLACES THEY ARE TOO YOUNG TO BE IN SHOULD BE JAILED AND/OR FINED. What kills me more, is this kid's "CRIME" has been EXPUNGED! GONE, NEVER HAPPENED. yet... he's still required to be a Tier 3 sex offender for LIFE. You people disgrace America, You people Disgrace freedom. Lady Liberty scorns you now.

I have a friend who grew up in the country. When he moved to Tulsa, he had to urinate so he did behind a home he was working on. Guess who, tulsa's finest citizens who instead of turning their head chose to call the police. They could not see anything nor were their any kids. He did not have money for an attorney and tusted "the justice system". Now he's a registered sex offender, is married and still lives like a "low life". Oklahoma citizens are known fo their hospitality, but instead of being good decent people they come off as hateful. Their is a difference between strong enforcement and pig headed hateful desires to hurt and uin peoples life. This guy lives among us and is as nice as anyone. I hate Tulsa's reactions to tragedy and ill fate. Let's incarcerate bad drivers, ugly women, fat people, slothful people etc. Strong enforcement with caring yet efficient punishment is better than the miserable trying to feel better about themselves. Read you Bible Tulsa.

It is not only Oklahoma laws which have over-reached and severely damaged the lives of young men like Ricky. Texas has charged, prosecuted, and incarcerated hundreds of young adults who pose no threat to public safety. Jail/prison over-crowding? Give me a break! My son met his girl in a teen club for 16-20 year olds, who was protecting him? When questioned, this young lady addmitted to lying about her real age! The age of concent law says ahild is not mature enough to concent to sex under oge of 16, yet a child of 12 can go to planned parent hood and recieve free birth contol(no parental concent)So who should be responsibe to teach the children these laws. And let's not forget that my son was 16 a *child* by law! So could your child be next??????

In the video is says, "An abstinence group says Oklahoma's laws are fair"...Reaping consequences as sex offenders for life." That is NOT the answer. The laws in Oklahoma are way over board. An abstinence group can only see one equasion here and that without any grace and mercy incorperated with these laws. Lifetime punishment is what they are talking about. There are so many unintended harmful consequences to these laws and the registries. The public needs to understand the research in order toto have sane laws that actually do protect children. 98 percent of those on the registries are either family members of the victim or were known to the family. Incest is NOT pedophilia. 1 percent or less of those on the registries are pedophiles. There is an excellent documentary entitled "Incest-A Family Tragedy" by Edward Blackhoff. Yes, the registries are really messed up for the Romeo's and Juliette's. Consider this. They are also just as messed up for the adults that are on them. I think we need to ask ourselves if this was the intent of the lawmakers. It wasn't of course, and should be amended immediately and retroactively. I'd like to thank Ricky and his mother for their willingness to share their situation with us. It takes real courage to put yourselves in the public spotlight.

Continued from last post: Ricky was seduced by a 13 year old girl who lied about her age. Yes! I am blaming the "victim". She was NOT a victim. She was a willing participant, engaging in intimacy twice with a guy she was dating. What is it about this act which makes it "The Crime of the Century"? The girl is now eating just fine. She has a roof over her head. And what about Ricky??? His 12 year old brother??? His Blind mother??? Who are the REAL victims here??? How many other Rickys and their families are being destroyed by your laws? Do any of you have an ounce of compassion and a degree of common sense which would allow you to recognize the truly dangerous criminals from the Rickys of this world who are not a threat to anyone? This is the Christmas Season. A time for Peace and Goodwill. And a time for Giving. Maybe you could give this family their lives back. Get Ricky and the other Rickys off that Registry. And, if I dare say, maybe you could help atone for what your laws did to this family, and send them a Holiday check so they at least have a roof over their heads to celebrate Christmas in. I do not believe you are BAD people. But, I do believe you have enacted BAD laws. You can just as easily change them. Merry Christmas!
