A McAlester man who prosecutors say violated a five-year-old girl has requested a jury trial.
FOX23 first told you about Bruce Montes in December. A court determined Montes was not mentally fit to stand trial. This trial came after similar charges were dismissed in 2006.
An assistant district attorney is now asking the judge to set aside the dismissal and order 24-hour supervision for Montes for the rest of his life.
The case will go to a jury in March.
