Immigration Process For Suspected Hit & Run Driver

A Tulsa woman hit and killed while on a morning bike ride and police say the driver sped off.

The suspected driver was arrested this afternoon where he faces charges in 74-year-old Beverly Duffield’s death.

Authorities are questioning the immigration status of 28-year-old Roberto Alvelais-Torres who is being held without bond.

FOX23’s Abbie Alford spoke to immigration authorities to explain what happens to a suspected illegal immigrant accused of a crime.

The Sergeant for the Tulsa County Sheriff’s Office who is certified to oversee immigration issues says even if it is determined Torres is an illegal immigrant it doesn’t mean he’s automatically deported.

Suspected illegal immigrants are treated like any accused criminal, they’re arrested and jailed but they have stricter bond rules than an inmate who’s a documented U.S. citizen.

"If we have enough evidence to put a [immigration] detainer on them for immigration purposes they will no longer have access to be able to bond out on a state crime and it will force them to go before a judge and explain why they're not going to be a risk of flight,” says Sgt. Shannon Clark.

Clark who is with the Tulsa County Sheriff’s Office overseeing immigration laws says judges consider the type of crime and they’ll also have to ask did the visa expire or do they have family members in the U.S. legally.

"The immigration enforcement aspect of dealing with someone that is illegally in the United States is as complex or complicated as the IRS tax code," says Clark.

lovejzmn...you are full of crap. There is no reason you cannot get a drivers license. If you find that you can't, you must be an illegal. Why don't you just call up the department of motor vehicles and ask them what you need to do to comply...if you can't comply...you are either stupid or you need to be deported, simple as that. All american citizens fcan get licenses, and I know a bunch of mexicans that moved here within the last couple of years that have drivers licenses and insurance and are perfectly legal. QUIT LOOKING FOR SYMPATHY FOR BEING STUPID !

Gosh, RidgleesDad why don't you tell us how you really feel! If you want to get the feel of what is happening in America right now, go to youtube and pull up the 10 minute spot called, manning speaks about mack daddy. I think this guy says the sentiment of most people right now. It is not a black or white issue, or a democrat or republican issue, it is a issue of what is happening to America. It seeems everyone "has their rights" except the average individual who has worked hard, obeyed the law, paid their taxes and other financial obligations, while others expect to be treated better, exempt from the law, have special priviledges, and no responsibility for their actions, all at the expense of others. I have said, and continue to say, hold THE EMPLOYER responsible for any actions of these illegals they employ. It seems logical to me if their employees are "ILLEGAL" they are breaking the law, and therefore that would make the employer an accessory to a crime or breaking the law. A VERY LARGE FINE for the employer could generate revenue to help subsidize the social programs these illegals receive. I guess that will never happen as long as they can reap the profits from the cheap labor, at the expense of those who obey the law.

It's always Illegal this, Mexico that. SlimJim is right, it's the law. Our laws(or the lack of) entice these miscreants to cross the border for a new life. Just a thought for those that take pity on the "injustices" illegals have. If I were not able to be a conforming American citizen, and generally could not be a contibuting member to my society , crossing to border to Mexico is probably what I'd do. Problem is, they don't reciprocate with "Sooner Care", "Food Stamps", and mandate that there be linguists that speak pig latin in public schools sucking up my taxes dollars. He has no rights in my opinion. Make him feel at home...just stick him in a hole and leave him just as they do in Mexico!If he's deported, he'll just wait till the bus leaves and here he comes again. At this rate, the Google Earth will adjust the boder and Texas and Oklahoma will be North Mexico. No, I'm not bitter.

Excuse me, but just what part of ILLEGAL do you not understand? Tolovejzmn, what makes you think you should be any different from anybody else who is required to have a driver's license? Do you not understand, THAT IS THE LAW. It should apply to everyone. Why do you think you should be exempt from the laws of this land that apply to everyone else, especially when you cannot, or will not, do what is required to be a legal citizen. Yes spiderbite I am interested in the status of this person, it's called being responsible for your actions. No license, no insurance, so what happens when you have an accident? Someone else has to pay for you not doing what is required of everyone else. I for one am sick and tired of my tax dollars being spent on social programs for ILLEGALS who want all the rights and priviledges of this country, and yet do not want to adhere to the same laws which apply to everyone else. As far as that feeble excuse, "they just want to work hard for a new life." There are people who have worked hard all their lives, and continue to do so, and they follow the law. Yes, they even have to get a driver's license and pay insurance. You are not even a legal citizen of this country, and yet you expect to be treated special, and be exempt from the laws that others have to follow.

Oh my GOD.. I can't believe you're more interested in the status of this person verses the fact that a lady was killed. I am sure it was an accident and that it was not like he was just waiting for her to pop out of the bushes to kill her. This lady had been my marriage counselor and a super nice women who had a passion for life and helping people. It was just her time to go and maybe it was just a case of her not looking both ways before crossing the intersection. Accidents happen and can take us by surprise. As for the man that ran away I am sure he was afraid of his status and the consequences of his actions.... fault or no fault of his own. I pray for her husband who has to deal with this loss. God Bless her family and and friends. I also pray for the man behind bars who has to live with this for the rest of his life. I am sure if Beverly were alive today that she would have forgiven him as that was just the kind of person she was. I wish you all could have had a chance to know her!

It seems to me as a former officer people from every walk of life kill pedestrians and commit hit and runs. If it were easy to be legal it would not be safe. But making a person pay for the fact that there parents entered illegally twenty years ago making them an illegal is not justice. In fact this country was built to help those that wanted to work hard for a new life and a new way of living. Where did that country go? Perumk

if we were able to obtain a driver's licese...believe me, we would go for it. its U.S. laws that prevent us from doing so. i have been in the U.S. since i was 3 years old & i am 21 now. i dont have a driver's license, but only because im not legally able to.

This same thing happened to my neighbor, an illegal immigrant just left the scene of the accident. They don't talk about this much when they're debating the whole illegal immigrant issue, but they don't have drivers licenses or insurance which becomes a huge issue if you are involved in a car accident with one of them. Not that there are really any consequences for them.
