Amber Hilberling, accused of pushing her husband Joshua out of a 25th floor window last June, is back in jail after her bail was revoked. The revocation of Hilberling's bond all boils down to marijuana.
The 20 year-old tested positive for the drug twice in the last month. The judge presiding over her case says there's no doubt she violated the terms of her pre-trial release.
Hilberling looked straight ahead while walking into court Friday refusing to answer a question from FOX23’s Adam Paluka, but after a 45 minute hearing which concluded with a judge revoking her bond, her lawyer, Jasen Corns, spoke for her, “Everything happened today as we knew it would.”
Hilberling twice tested positive for THC which is a chemical compound found in marijuana.
“They allege that some things occurred around Thanksgiving, and we're not here to argue with them about whether they did or didn't. The tests speak for themselves,” Corns said.
Hilberling’s lawyers are confident this won't affect her jury trial in the death of her husband.
“This won't even come into evidence at trial. This won't affect trial at all, and we plan to win at trial,” Corns told FOX23.
He was not shy about sharing his defense strategy.
“The most important fact in this whole case is that my client was a victim of chronic abuse throughout her pregnancy, and she is not guilty of murder. She will be cleared by a jury, and we're looking forward to that day.”
While that will be up for the jury to decide, there are facts no one can dispute. Joshua Hilberling is dead; Amber Hilberling is now in jail again, leaving their baby, Levi, in the care of Amber Hilberling's parents.
The assistant district attorney prosecuting this case did not speak with reporters after the hearing, and with Hilberling's bond now revoked, she'll remain in this jail until her trial.
Hilberling’s case is scheduled to go to trial this summer, but her attorneys said they may try to move that date forward in the coming months.
