Deputies involved in fatal shooting identified

A well know known art teacher is shot and killed in a deputy involved shooting.

9:25 am Wednesday morning, Okmulgee County deputies were called to a rural home in Morris after they received a call about a potentially suicidal man.

Deputies said Robert McMurtry, 61, was distraught, armed with a machete and came at deputies.


Sheriff Eddy Rice said the two deputies used a taser and when that didn’t work they were forced to use lethal force.


There's a mural painted by McMurtry on the wall near the Morris Library in downtown Morris marked in 2002.


His students told FOX23 News they called him Mr. Robby and they want to remember him as their art teacher who made them a better person.  


Teaching came as easy as a brush stroke.


Mr. Robby was known to bring the artist out in every student. Many had him as a teacher since they were in elementary school.


“He taught me how to draw and I know nothing about drawing,” said Tiffani Burgess.


She had McMurtry as a teacher from when she was in kindergarten and until she graduated high school in 2010.  Another student had him when he was in the eighth grade.


“It doesn’t matter if it’s good as long as you put in the effort,” said sophomore Shan Edmonds of McMurtury.


Other students agree they were not talented artists, but they enjoyed being around him.  


“He made it fun. I loved art and whenever it was time for Mr. Robby to come in it was awesome,” said 2011 Morris graduate, Katy Franklin.


For decades Mr. Robby taught art for
Morris Public Schools in the elementary, middle school and high school classrooms.

“I grew up with him. I grew up knowing him. Just really hard,” said Burgess.

County deputies say they were called to McMurtry’s rural Morris home on Wednesday morning for a welfare check.

Sheriff Rice said McMurtry was distraught and they tried to talk to him. He said the deputies knew him as their former teacher.


“He was unable to calm down. It kept escalating,” said Rice.


He said McMurtry was armed with a machete. They deployed a taser.


“You have to have to have a complete circuit. Only one taser barb in and the other did not and we don’t believe it was effective,” said Rice.


The sheriff said that’s when one of the deputies pulled out his gun and fired one shot.


“At that point they had to defend themselves and take Robby’s life,” said Rice.


Students said they are in shock about what happened.


“He was never that type of person. He was encouraging to all of us,” said Burgess.


No one knows why this happened but his students are remembering his legacy as an artist, novelist and teacher.


“It’s hard for me to imagine for Morris not having Mr. Robby and all the kids who are not going to have him and be taught by him. My heart breaks for them for not being able to know him and for everyone to think something that he is not because he was such a great person,” said Burgess.


Morris School Superintendent James Lyons told FOX23 on the phone that McMurtry was a “real dandy.” He said he was well-liked among teachers, students and the community.

Both the school and Sheriff Rice said their prayers are with McMurtry’s family.


The sheriff said McMurtry was married. His wife and no one else were home at the time of the shooting.


Once the Oklahoma State Bureau of Investigations is finished with its investigation the Okmulgee County District Attorney will determine if the shooting is justified.


The deputies’ have been identified as Chief Investigator Michael Stacy and Investigator Smokey Patchin.


Sheriff Rice said the last deputy-involved shooting in the Sheriff’s Office happened in 1994.

Okay,I've waited for something to happen, but as I figured.....nothing. The comment of there being no machete is false. There was a machete. Okay now, also the comment of him being shot twice, is true. There were actually three shots fired. A neighbor heard this and also said that it was 45 minutes before sirens were heard after the gunshots. Okay, this goes out to Fox23. Are you going to follow up on any of this? This is a story. Corrupt cops, lies, death, what else do you need? Should I get in touch with Channel 2? Two News works for you! Get in there and poke around, get to the truth. That's what good reporters do....anyway, like I was saying, I guess I'm off to Channel 2's website. Come on, f**k around! Somebody do something. It's already dying down and fading away. They're going to get smooth away with this. 'THEY' being Patchin and Stacy. A**holes.

Many departments have "cliques" where the price of admission is shooting someone. Once you are in the club you can get a tattoo to commemorate the event. Google "Jump Out Boys" or Grim Reapers, Little Devils, Regulators or Vikings. Those are all gangs within police departments.

Robby wasn't trash. He was a gentle person. I don't know how things escalated to this point, but just because a cop/deputy says it's so, doesn't always mean it's so. They are just a person with "authority" with a gun. Damn, this was so senseless!I truly believe no matter what, there could have been a much better outcome... so sad. He was my cousin, so I KNEW Robby. I can say what a good, gentle, kind, helpful and caring person he WAS... such a sad word, "was", when used like this. I WILL MISS HIM.

Isn't Smokey Patchin supposed to be a "Less Lethal" and TASER instructor? According to an Armed Defense website, he is an instructor there. Okmulgee is a sad place, especially being "protected" by these types of people!

@okmulgeeposuck: you are so right about getting shot by those clowns for leaving these comments lol. I MYSELF watched Mike Stacey sit on stand and lie. He cant have a conscience if he can still sleep at night after doing so many people wrong in this county so im sure this wont affect him either. He's probably proud of himself in some sick way. I dont know Patchin so I cant say anything aout him but with Stacey i could go on all day. I just wonder why it hasnt came out why he is a deputy now and not the investigator for the OPD, but none of their crooked ways is ever reavealed. Someone said "poor Mike, this is going to mess with him for the rest of his life" poor Mike my a*@!! i hope it does and maybe just maybe it will make him change his ways.

Showing up armed and escalating the situation pretty much cancels out their "self-defense" claim. Handing this over to the OSBI is also no guarantee justice will be served.

Man I just watched the news clip on this. Did anyone else notice how Rice was stuttering and stumbling all over his words? It's because he's lying. He knows what he was told is bull**it. Man, come on. And the OSBI investigating? The O in OSBI stand for Oklahoma. Get an outside investigator. Good Lord can someone with some kind of power get involved in this and do something about it. Wow. I can only hope that people will look closer at the story and the video and see the truth. The deputies say they knew him and still couldn't talk him down. Where are the negotiation skills? Watch Criminal Minds and you can learn better skills than these two clowns. Unbelievable.

Okay, let's see. Where to start. I've read all the comments and noticed that people seem to automatically believe what they're told. On both sides of this issue. How do any of you know that what you are being told is the truth? Not even Rice knows the truth and he is the sheriff. He wasn't there. So keep that in mind. Only Patchin and Stacy know the truth now. And they are both idiots. I know them, especially Stacy. I also know Robby. The guy weighed 80 pounds soaking wet. Even with a machete he was not a threatening figure. Stacy is a big, bald person and Patchin although he is short is about as round as he is tall. Both outsize Robby considerably. Bottom line is they go to all kinds (or should have) of training. Do they not teach you how to aim a handgun? Okay, skip to another issue. The police department is so foul around here. Remember the police chief and his comments concerning the fire chief and the cheating on his wife thing? What the hell happened with that? Same thing that will happen with this. Nothing. This whole thing stinks of bad police work. Learn how to use your taser, learn how to point your weapon. You can diffuse a situation and remove the threat without killing someone. If you don't agree you need to fill out an application for our police force. You'll get hired. For God's sake, look at Robby's picture. The man is peaceful and so non threatening. Yeah, maybe he was distraught and upset. And he was the kind of person to protect his home and property, but shooting to kill? Not needed. The police force needs to be examined, closely. This is ridiculous. Hell, if someone doesn't turn themselves in, our police wouldn't solve any crimes. They are unable. Look, what really happened out there? What we're being told isn't the truth. Those two (Stacy and Patchin or Beavis and Butthead) will cover each other. Man if this gets by, watch out. You could be shot and killed by Stacy or Patchin for leaving bad comments............Uh, I gotta' g
