Two Victory Christian Center workers charged with failing to report child abuse have filed a second motion to dismiss the charges.
The attorney for John and Charica Daugherty filed the new motion on November 2nd, alleging the charges against the couple should be dropped either because of a lack of evidence or because the evidence as it is known has either been disproved or is outright false.
The state filed a strongly worded response to the original motion to dismiss yesterday; the motion filed by the defendants today calls that response: “hyperbole, self-righteous indignation, and misrepresentations by the Tulsa County’s “justice” office.”
The motion alleges the defendants are “targets of a political smear campaign rather than a criminal prosecution.” They also claim the mother of one of the alleged victims, the grandmother of another alleged victim and a TPD officer should also be charged because they had access to the same information as the Daughertys.
The motion says the charges must be dismissed because the timeline and facts presented by the state can be contradicted by witnesses and evidence.
A hearing is expected for November 19th.
