It has been five months since Summer Osborn and her family ordered food from Burger Express Delivery near the 2300 block of West 41st St. in Tulsa.
"We had burgers delivered back in January," Osborn said that first order was also her last, or so she thought. "It took approximately three hours to get our food and it was cold and it cost thirty bucks."
It wasn't the quality of the food that Osborn was concerned about on Monday morning.
Osborn sat down to check her bank account before she paid bills and was startled to find an odd charge. "I didn't spend $250 dollars at a burger place for dinner," said Osborn about the hefty charge on her bank statement. "The first thing I did was call the bank and tell them they had to stop it."
Osborn said she was panicked and filed a discrepancy report with the bank so her money would be refunded.
Osborn then dialed the phone number to Burger Express Delivery. "I thought maybe there was some kind of an accident," said Osborn. The recorded message to the restaurant stated that Burger Express Delivery was closed until further notice.
The restaurant was shut down by the Tulsa Health Department on May 25th. The business failed the last two health inspections and the inspectors report cited a "lack of managerial control at the restaurant."
Osborn contacted FOX23 about the mysterious charge.
In the last 24-hours others have reported similar charges on their bank statements. A review on the Urban Spoon website posted in reference to Burger Express:
"They took $251.00 out of my account as well!! I'm sooo upset right now!! "
The owner, who rents out the building space, Robert Crow, told told FOX23 the building has belonged to his family since 1947. "Your information was new to me," said Crow, "It sounds like somebody has been defrauded." Mr. Crow said he was shocked and saddened to hear about the charges. "Things aren't the way the used to be, are they?" Crow said.
Prior to the May 25th closing, Robert Crow had rented the building space to Stuart Otis. Crow said that Otis operated the Burger Express Delivery.
FOX23 contacted Stuart Otis about the matter and he said, "I am no longer in charge here and I have no idea what happened."
Right now, there are questions than answers about how the charges happened.
Osborn said she has contacted her bank and will file a police report.
"It's not right, " said Osborn. "I work two jobs trying to fix a broken down vehicle and then somebody takes my money."
The Tulsa Police Department said the fraud unit will investigate. If you think you have been a victim please file a police report with TPD.
