City Councilor can be on TARE board says City Attorney

City attorney David O’ Melia says District 3 Councilor David Patrick can serve on both the City Council and the TARE Board without conflict.

Councilor Patrick recused himself from any discussion on TARE at the January 26th City Council meeting.  He did so at the precautionary recommendation of O’Melia.  At that meeting the council delayed a vote on whether the Tulsa Public Facilities Authority would finance the purchase of 250,000 solid residential waste carts.

In a state released Monday, O’Melia said an “organizational” conflict of interest does not apply to the dual role situation Councilor Patrick is in or the current circumstance.  Patrick will participate in the upcoming vote to determine the financing of carts.

The City Council is expected take the vote at a 1:00 p.m. special meeting Thursday afternoon.
