Muskogee Police arrested and charged a man with armed robbery on Thursday.
Police said the convenience store located at 54thand Okmulgee in Muskogee County was robbed around 4 a.m. Thursday.
Police said a man walked into the store and pointed a gun at the clerk in the back office.
Cpl. Michael Mahan with Muskogee police said, “He (the suspect) demanded that he (the clerk) empty his pockets.”
Then police said he went back to the front of the store where he did not get money from the register.
Mahan said, “He (the suspect) basically started picking up tobacco type items and began loading them in a bag.”
That was when police said the robber noticed someone else in the store. Mahan said the robber said something unusual to the customer.
Mahan said, “(The suspect) Basically told him ‘hey, take what you want while you’re here.’”
Mahan said that person took a pack of cigarettes and walked out of the store.
He said, “He (the witness) told us he did that because he basically was in fear for his safety.”
Police said surveillance video showed the customer returned the cigarettes after the suspect left so they didn’t charge him.
Police did arrest and charge Jerman Asberry with armed robbery.
Police said he (Asberry) flagged down officers about 10 blocks away.
Mahan said, “At this point we don’t know why he flagged the officer down. We don’t know if he panicked. It doesn’t appear he did it to turn himself in.”
Mahan said the officer he flagged down realized Asberry matched the description of the suspect.
Police said no one was injured. Asberry was being held at the Muskogee jail Thursday.
