Cleveland police arrested 37-year-old Lynn Marie Smith Friday night right before she said she was about to turn herself for being accused of providing alcohol for minors and for stealing from a liquor store.

Police tell FOX23 News five people were at a drunken sexual party that included teenagers at 12-years-old, 13, 15, 16 and 18-year-old Daniel Allen Arbuckle on June 5th.  Police Sgt. Robert Stephens said after interviewing the 12 and 13-year-old girls he learned Arbuckle had sexual intercourse with them and had oral sex with the other girls there.

Arbuckle was arrested last month on rape charges and made his first court appearance.  He sits in the Pawnee County Jail.

Smith arrest warrant was issued on July 16th.  FOX23 talked with her after her mother bonded her out of jail Friday night around 7:30.

“It’s not fair; it’s not fair at all because I know in my heart, I didn’t buy alcohol for minors,” said Smith.

Smith admits she stole a bottle of liquor from the local liquor store in Cleveland and put all the bought and stolen alcohol into the refrigerator when she arrived back at her boyfriend’s house, where the party happened.

“He was drunk, when I walked in,” said Smith.  She said she could hear music blaring when she pulled up.   “He was taking shots, and there are no charges against him at all.  I told him that none of the people needed to be there, and he told me it was his house and I could leave.”

She left the house, she said.  Her mother, Rhae Smith confirmed her daughter stayed with her that night.

They did not find out until days later what happened over at Smith’s boyfriend’s house.  Rhae Smith said she talked to the 12 and 13-year-old girls who told her they consented to having sex with Arbuckle.

“The exact right words that came out of their mouths were, he was having sex with one, and the girls were licking caramel sauce off each other and everybody just switched off except one little girl refused to have sex with another girl,” said Rhae Smith.

Lynn Smith does not understand why she was never questioned by police to hear her side of the story nor does she understand why her boyfriend, the owner of the “party house” has not been questioned either.

Arbuckle is being held on a $100,000 bond.

What is this world coming to. And BTW: We can't keep blaming that it's because prayer has been taken out of school. Just remember if prayer, Jesus and Christian is allowed in school, so is Allah, and Buddah, and Athiest, and Scientology.....It is FREEDOM OF RELIGION that our country has. So, if you want to allow 1, you have to allow them all. I don't want other religions teaching my children. Can't blame it all on the parents were Pentecostal preachers, I still rebelled! The guy that owned the house, who was there......needs his butt put away for a while. If that was my 12 year old daughter....I'd be racking some heads!!

Most children are raised by their grandparents now while the so called parents are still partying and unable to hold a job down,a lot of women have kids by 3 or 4 men and often aren't sure who the real father is,the communists said they would take us without firing a shot and taking God out of our lives and destroying the family unit are some of the methods.

I have to agree, this whole country has gotten so far away from God. We were once the greatest nation in the world, with "In God We Trust" on our money; and most of the coutry truly did trust in God. Now, too many non believers... My Mom & Dad married 50 years.. unheard of now. Kids alone, no direction, lost put between Mom & Dad... May God Have Mercy On Us All!

Ruthie you along with everyone else are correct if you are bashed for your opinion just know it's not a believer it's a soddomite. I'm young (under 30) but it was things like this that made me decide to be a stay at home mom. My kids are not prefect but they know right from wrong and they can tell you. They refuse to even use language. Raising self respecting kids is a process and it only takes one loving person to care and make the sacrifice and do it.

Sorry, that was "day care workers are NOT concerned if your children are raised with morals or values."

Look back many years ago, those of you that are old enough, and see what happened when we thought we had to keep up with the Jones' and women went to work and left their children in day care for somebody else to raise. Day care workers are concerned if your children are raised with morals or values and since both mother and father are working and coming home in the evening too tired to spend quality time with their children, they were not teaching morals, values or life skills either. Then when men and women were working closely with the opposite sex (other than their husbands)for more hours a day than they were spending with their own spouses, the divorce rate started climbing and has never slowed down, especially in the state of Oklahoma where we have "no fault" divorce. So, the break down of the family occurs. Breaking up families and putting kids somewhere in the middle of "mom's house or dad's house", where is THEIR house? It's never "I'm going home", it's I'm going to my mom's or I'm going to my dad's. Now, with mom and dad both single, they have to have their "fun" and social life. Still nobody is teaching the kids morals, values, life skills. In fact, they are watching their parents do whatever they want and getting mixed messages about right and wrong. Parents are not paying attention to their kids and every pedophile knows it. Kids are not getting the feeling of structure, stability or security they need. It all started a long time ago but I doubt very many people will look back that far or admit what has caused this huge problem. Nothing can be fixed if you can't trace back where and how the problem started. All that's being done is a band aide put on the symptoms. My opinion is NOT a popular opinion and I know I will get bashed on here for saying it, but...oh well.

This country will not look the same in 10 years,I do not see it staying together much longer the way things are going, Texas will be the first to leave. The form of gov't we are in now is not representitive of law abiding, hard working, religious people and not much hope for change.
