An escaped inmate back in custody faces new charges.
James Maxell faces charges of possession of firearm, possession of marijuana, resisting arrest and escape from penal institution. The arrest report shows police had to use a taser on Maxwell to take him into custody.
The Northern Oklahoma Violent Crimes Task Force and DOC fugitive agents located 49-year-old James Maxwell in Berryhill in the 4400 block of South Gilcrease Expressway Wednesday night.
Law enforcement says Maxwell was in a vehicle with three other people including his daughter. During the stop Maxwell ran, but officers were able to apprehend him.
James Maxwell, shirtless and covered in tattoos including several Swastikas, is back in jail.
The Northern Oklahoma Violent Crimes Task Force, DOC Fugitive Agents and Tulsa Police coordinated the manhunt. Inside the truck he jumped from, officers found more than $3,000 cash, meth and a gun.
"He had a lot of resources to probably get out of town and probably out of the country,” said Deputy US Marshal Chad Hunt.
This isn’t Jimmy Maxwell’s first run in with the Marshals and Tulsa Police.
"When we were chasing him three years ago he did run from us and he did fight with us and he did have a shotgun with him,” said Hunt.
He assaulted one of the officers which landed him in prison.
"We definitely brought everything out on this case,” said Hunt.
Officers from four agencies saturated the area and hunted down Maxwell in West Tulsa.
He’d been on the run for at least ten hours.
"With his criminal history and what he is capable of we want to bring everybody out that we could on this,” said Hunt.
The driver of the truck is convicted felon, James Wagoner, 30 and Stephanie Starr, 35, who Maxwell calls his daughter. Starr now faces charges of harboring a fugitive, possession of a firearm and possession of marijuana. Arrest reports show Starr admitted the gun and drugs found in the car belonged to her.
"There was a gun on him when he stepped out of the vehicle and ran but when he apprehended him he didn't have the gun on him," said Hunt.
Officers say after a short pursuit, Maxwell was cuffed and back in a patrol car. He had three years left on his sentence and now he’s staying even longer.
Maxwell is expected to go back to a medium or maximum security prison.
DOC Spokesperson Jerry Massie says Maxwell had a projected released date in three years. Massie says Maxwell didn’t show signs of violence and was moved from Cimarron prison (medium) to Vinita (minimum) last month.
“Given his conduct and his institutional adjustment and sentence length, he was classified as being eligible for minimum security.”
Massie says Maxwell was there for count at 5:30am on Wednesday morning and not there for count at 7:30am.
Sources tell FOX23 News, Maxwell escaped by jumping a fence.
Last fall, three inmates escaped from the Vinita prison and were caught shortly after. DOC says it reviews prison procedures and reviews whether changes need to be made after a prison escape.
“You always want to look at your procedures and make sure what you are doing is working,” said Massie.
Vinita does not have physical barriers such a double fence or razor wire around the facility.
The Northern Oklahoma Violent Crimes Task Force, DOC fugitive agents and other law enforcement agencies worked together to find Maxwell. Massie says Maxwell is in prison for assault and battery on a police officer.
