Boston bombing suspect will not be charged on Sunday

The only surviving suspect in the Boston Marathon bombings will not be charged on Sunday, according to the Justice department.

Dzhokhar Tsarnaev,19, is currently in serious condition in a Massachusetts hospital. He is sedated and unable to speak.

Massachusetts does not have the death penalty but prosecutors could seek capital punishment, at a federal level.

Tsarnaev and his older brother are accused of placing the bombs near the finish line of the Boston marathon on April 15. The explosions killed three and injured several others. The other suspect died in a shoot-out a few days after the bombings.
