FOX23 said the three-year old at the center of an Amber Alert is in DHS custody and the alert has been canceled.

FOX23 reported Tuesday night that Kegan Manning was taken by his father, Johnny Manning, from his mother at Lake Tenkiller. They were last seen at Johnny Manning's father's home in Tulsa, but could also be in or around the Bristow area.

FOX23 spoke exclusively to Kegan's grandfather, who says the whole case has been blown out of proportion.

Cherokee County deputies say Johnny Manning slashed the tires of a vehicle his wife was driving, and had her sign custody papers, that deputies say are likely not legitimate. Deputies say he then went and got Kegan and left with him.

Follow-up to my previous comment: There were 3 protective orders filed in February 2011 by the Manning family and approved by a Tulsa District Court judge in March 2011, to be effective for a three-year period. The first was filed by the elderly Manning (Johnny Max Manning) against his son (and Kegan's father and Tabor's husband--Johnny Michael Manning). Three days after Max filed his PO, Tabor and her husband each filed a PO against the elderly Manning.

On March 8, 2011, in Tulsa District Court, a final protective order was approved by the judge to be in effect for three years that stated Johnny Max Manning was to keep 300 feet away from Tabor Manning. That means he broke the rules of the protective order, which was still in effect, when he approached her that night. "JUDGE HOGSHEAD: PLAINTIFF PRESENT, PRO SE. DEFENDANT PRESENT. PRO SE. THREE WITNESSES SWORN, JOHNNY MAX MANNING, JOHNNY MICHAEL MANNING AND TABOR MANNING. TESTIMONY TAKEN, HEARING HELD. FINAL PROTECTIVE ORDER GRANTED FOR SELF ONLY FOR THREE YEARS. DEFENDANT IS TO REMAIN 300 YARDS FROM THE PLAINTIFF, THE HOME AND WORK. EXCEPT PLAINTIFF MAY PICK UP FURNITURE THAT WILL BE ON THE DEFENDANT'S PORCH TONIGHT (3/8/2011 AT 7:00PM ONLY) COSTS TO THE DEFENDANT. " Tulsa District Court Case No. PO-2011-538

The father says it is being blown out of proportion: he took the child, destroyed property, extorted the wife into signing false documents by force/knife, and is ignoring the Amber Alert---oh, and I bet he misses the court appearance scheduled for this morning. Dad, your son did and is doing stupid things, if you know where to find him, turn him in and start over by following the law to the letter. Force does not equal visitation.
