The Americans With Disabilities Act (ADA)
The Americans with Disabilities Act, also known as ADA (A-D-A), protects qualified individuals with disabilities against employment discrimination and requires employers to make reasonable accommodations for them in the workplace.
Bona Fide Occupational Qualification (BFOQ)
As you may already know, it's unlawful for employers to discriminate on the basis of age, religion, gender, or national origin when hiring or terminating an employee.
Disability
If you're disabled and are qualified to perform a particular job, the American Disabilities Act, also known as ADA (A-D-A), protects you from any employment discrimination based on your disability.
Psychiatric disability
Individuals with psychiatric disabilities often face employment discrimination because their disabilities are either stigmatized or misunderstood by employers.
National origin
Under the federal Civil Rights law, you can't be denied an employment opportunity because of your birthplace, ancestry, culture, or linguistic characteristics.
Pregnancy discrimination
According to the statutes under the federal Pregnancy Discrimination Act, employers must treat women affected by pregnancy, childbirth, or related medical conditions in the same manner as other employees or applicants with the same skills or limitations.
Religion
It's unlawful under the U.S. Civil Rights Act for employers to discriminate against individuals for their religious beliefs in all areas of employment practices, from hiring to termination.
Sexual discrimination and harassment
Whenever employers treat individuals differently because of their gender, its known as sexual discrimination. If such discrimination affects the terms and conditions of an employment relationship, it's considered illegal and companies can be held liable for their actions under the federal Civil Rights Act.
Verbal harassment
The first amendment of the Constitution protects a person's freedom of speech, but if an individual's speech is of a derogatory nature and occurs repeatedly in the workplace, it can constitute harassment in certain areas of federal employment laws.
Hostile environment
Both federal and state civil rights laws afford employees the right to work in an environment free from hostility. This means you have the right not to be subjected to any type of discriminatory intimidation, ridicule, or sexual harassment that's severe and pervasive enough to affect your employment conditions and create an intimidating or offensive work climate.
Fair labor standards
The Fair Labor Standards Act, also known as FLSA (F-L-S-A), is perhaps one of the most complex and important employment laws in effect as it governs a worker's right to be paid fairly.
Age discrimination in employment
Whenever age becomes a factor, instead of skills and qualifications, in determining a person's job status with a company, it's known as age discrimination.
Assistance for individuals with disabilities
If you've experienced discrimination in the workplace because of a disability, there are many sources you can turn to for legal assistance and information.
The Civil Rights Act
Title VII (seven) of the Civil Rights Act of 1964, the primary source of anti-discrimination law in the United States, was enacted to protect individuals from being unfairly denied employment opportunities because of their membership in a particular group or class.
Equal employment opportunity
Employers are legally bound by federal law to provide fair and equal opportunity to all employees and applicants for employment, regardless of the individual's race, religion, national origin, sex, disability, or age.
Equal opportunity for individuals with disabilities
In the past, some employers have requested information about an applicant's physical or mental condition in order to exclude applicants with disabilities before their ability to perform the job was fairly evaluated.
Employment discrimination
The use of any employment selection procedure based on race, color, national origin, sex, religion, age, or disability is considered illegal under federal law.
