TULSA, OK -- A Tulsa man found half naked in a van with a 2-year old girl is scheduled to head back to a Tulsa County District courtroom on October 19th.
Marcus Berry, convicted two times for sex crimes involving children, was released from prison in 2006. He has been ordered to stand trial for the August incident.
ORIGINAL STORY -- On the night of Aug. 12, police say Berry drove around a North Tulsa neighborhood, found a little girl and allegedly molested her. While neighbors were horrified to know what happened,
Barbara Stevens says it is worse knowing that Berry should’ve been in jail.
Stevens said, “They should’ve done something about it. He shouldn’t be free.”
Since Berry was released from prison in 2006, he’s been arrested 2 different times for violating the sex offender registry. The first time, a jury acquitted him because he said he was homeless. The second time, he plead guilty as part of a plea deal. In exchange for his guilty plea, he received a 2 year suspended sentence and avoided going back to prison.
Police want to know how this sex offender seemed to slip through the courtroom cracks.
Officer Jason Willingham said, “Obviously we would love to be able to say this guy was in prison and wasn’t able to recommit his crimes… it’s frustrating. It could have been prevented.”
