Tulsa Sex Offender Gets New Court Date

TULSA, OK -- A Tulsa man found half naked in a van with a 2-year old girl is scheduled to head back to a Tulsa County District courtroom on October 19th.

Marcus Berry, convicted two times for sex crimes involving children, was released from prison in 2006.   He has been ordered to stand trial for the August incident.
 

ORIGINAL STORY -- On the night of Aug. 12, police say Berry drove around a North Tulsa neighborhood, found a little girl and allegedly molested her. While neighbors were horrified to know what happened,  
Barbara Stevens says it is worse knowing that Berry should’ve been in jail. 
   
  Stevens said, “They should’ve done something about it. He shouldn’t be free.”

  Since Berry was released from prison in 2006, he’s been arrested 2 different times for violating the sex offender registry.  The first time, a jury acquitted him because he said he was homeless.  The second time, he plead guilty as part of a plea deal.  In exchange for his guilty plea, he received a 2 year suspended sentence and avoided going  back to prison.  

  Police want to know how this sex offender seemed to slip through the courtroom cracks. 

  Officer Jason Willingham said, “Obviously we would love to be able to say this guy was in prison and wasn’t able to recommit his crimes… it’s frustrating. It could have been prevented.”

I know of a 6 year old girl that described in great complete graphic detail how her "papa" sexually molested her. DHS took her from that home and made her mother move out and take parenting classes. Now they put the child back with that mother. What about the sicko that raped a child....nothing, not a thing. The great widsom of tulsa county could only tell me sorry, they only take cases they think they can win and she was too young and messed to testify. So "papa" now could be living in your neighborhood and looking for (or already found) his next "special friend". What do we do???? The little girl has been on medication and in counseling, she will never be the same. There is nothing right about this and we just take it because nobody will speak for the victim. Where are the lawyers that care about the children.....

What I feel is a shame regarding the politics of this situation is that Berry is a REPEAT offender. He never was individually accessed which in my opinion, he would have stood out like a sore thumb and Oklahoma could have dealt with him and this entire situation could have been prevented. There was to be an Interim Study on the Adam Walsh Act but Rep Rex Duncan did not approve it. He cited the costs. I did some investigation and found out the cost was ONLY $1200.00. At a time when we need, very desperately to have the understanding the RESEARCH that would PREVENT situations like this we negate the research, in favor to the statuesque. Laws that do more harm than good, laws that endanger children and the whole of our society. $1200.00 against the millions of dollars that Oklahoma is spending on ineffective, knee jerk laws that protect no one yet endanger everyone. Shame on Rep. Rex Duncan, Sand Springs. What ever happen to "If it saves one child?" And shame on all the law makers who continue along this same vain. "Laws that do more harm than good." Laws that do not have one bit of research. How stupid is that. The law makers are responsible for this two year old being kidnapped because had they relied on evidence based research in making these laws, Marcus Berry at the very least would have been under strict supervision or kept locked up.

HOW IN THE WORLD,does a guy like this get by in the first place;of not registering?I just donot understand how this was what...overlooked?someone is not doing their job,wouldn't you say?I just don't know!Johnny

It sounds like a good idea to me to have the judges & folks who are supposed to uphold the law (but who don't) & child abuse monsters shipped out to sea & dropped into the middle of the ocean. That is a way to get rid of the repeat offenders and take care of the prison overpopulation.

That is exactly my point, the names of the judges who made the decision to slap these perverts on the hand and turn them loose, should be published so that the voters can replace them when it comes election time. Sooner or later there has to be some accountability by the DA's office, and the court system, to insure that these type of offenders are not just slapped on the hand and thrown back into society to offend over and over.

We have judges that we have to vote on to keep or who knows, but what kind of record do these judges really have? Are they part of our problem? We have politicians who may not care or maybe just a little dishonest. We have the same thing with our lawyers who hope to be politicians. Then you have a small part of our law enforcement officers who break the law themselves. No, I do not want to commend everyone. There are a few good politicians, judges, lawyers, and cops out there. But it seems they are few and far in-between. We need to support the good ones. We need to weed out the bad ones. Like I said, I do not have all the answers, you tell me what we need to do?

These are sad times we live in today. Our courts are so tied up that they have become a revolving door and full of plea bargains, miss-trials, bleeding hearts, and lawyers that will do anything for a buck. We have passed laws to protect our young, but that has backfired on us. A youth under eighteen can go down the street selling drugs, walk into a convenience store and rob the place, or how about just plan killing someone. The day the youth turns eighteen, their records are sealed and they have a clean record. We have crooks that are getting smarter and using the laws to their favor. They can rape a small child and know they will probably get off because when the child has to testify against them in court, their lawyer will get the child confused and twist around their testimony so that a jury may not be sure of what really happened. Sad, but true. Hence, the prosecution may go for a plea bargain to get this person off the street for a short time and make them a registered offender. But then they are in the system and fall through all the cracks that look like any good Oklahoma road, (full of huge holes). I do not know the answer, although I do know what I would like to do with some of these predators. And I do not see much difference raping a child or giving them drugs. We have a system that is out of control. Our courts are so busy they have no time to prosecute all the offenders. Then again, we have way too many repeat offenders. Our prisons should be a place you would not want to go back to. It seems too many who get out of prison do almost anything to get back into prison. If some of the bleeding hearts had to go through what the victims, maybe they might want the predator off our streets. I do not know what to do. I think we are all entitled to know how this slug slipped through the crack in the judicial system. This crack needs to be plugged immediately so this type of incident NEVER HAPPENS AGAIN. Who were the judges in the previous court cases, and who were the ones in the district attorney's office who accepted the plea bargain? The judges, and those in the DA's office who allowed this to happen, should be dismissed and held accountble asap. Had this been done in the first place, this incident would never have happened. Politicians, and those in authority positions to enforce the laws, need to wake up to the fact that the average citizen is fed up, and sick and tired, of how this country is being destroyed by the incompetence of their performance. I think this will become quite evident in the future elections. It won't matter if they are Democrat or Republican, or even a long term encumbent. They better listen to the voice of the people, or they WILL BE replaced with someone who will. Maybe, just maybe, that is the message that Mayor Taylor got loud and clear.
