No A/C: Your Rights As A Tenant

Imagine your condition not working and your landlord won’t fix it.

This is an update to a story we covered over the weekend about some resident living in a South Tulsa complex that said their A/C was not working or getting fixed.

Since the story aired on FOX23 those tenants now have working air conditioners.

But many viewers are telling us they’re no so fortunate.

Veronique Walker says not having a reliable cooling system in her apartment is just too dangerous for her three-year old daughter.

"I notice that she has heat rash because it's hot so I try to keep her and cool and give her a cool bath and that will only do so much," says Walker.

Over the weekend, she couldn’t get the window unit to kick on until late last night.

"You have to turn all the knobs,” says Walker. “It has a mind of it's own basically."

She says she called the landlord but he did nothing until we showed up this morning.

"Track record is 24 hours. If we have one on site etc and it's any day but Sunday, my company we're off on Sunday, we are there.  As you can see it's Monday morning and we have an A/C unit," says Chuck Boyton.

only a change in state law will help require landlord to make repairs in 36 hours minimum to heating & cooling units. Contact your Oklahoma senator to make change in state law.

To whom and where do they report a hazard? I am a home visiting nurse and have clients that have been without heat and air for over a year. The landlord refuses to make repairs. The majors action line says a complaint can be filed but tenants are generally evicted due to complaint before anything can be done. These folks are pregnant and/or have babies. It is criminal what landlords get away with here.

Its not fair to give the landlord 14 days to fix your A/C unit when its 102 something degrees outside, and you and your children has to be in the heat while everyone else has working A/C.I feel that its only fair for the landlord to pay for a hotel until they can provide the service needed to get your A/c unit going again,and pay any medical bills that you got because of being without air.

Mama 2002 I totally agree with you! It's like when you move in they are so nice and helpful then when you sign that lease and you have a problem they could careless but we still have to pay rent reguardless if the home is in living conditions or not! I am tired of that! Especially if you are a awesome tenant that has never been late or caused problems It makes me sick!

Health Hazard and they have 14 days to fix it! Come on. Ok fine let them live like that for 2 weeks and see if they are willingly going to risk their health.
